Acceptance of terms
By downloading, installing, or using the Presensense app or website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.
By accepting these Terms, you also acknowledge our Privacy Policy, which describes how we collect and handle your data.

About Presensense
Presensense is a location-based visit tracking application developed by VibeXApps. It allows users to log visits to saved places, track visit history, set visit goals, and receive location-based reminders. The Service is provided "as is" and is subject to change as we continue to develop it.

Eligibility
You must be at least 13 years old to use Presensense. If you are between 13 and 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
By using the Service, you represent that you meet the age requirements above and that you have the legal capacity to enter into a binding agreement.

Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account.
- Keep your login information secure and not share it with others.
- Notify us immediately if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable use
You agree to use Presensense only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, state, national, or international laws or regulations.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any component of the Service.
- Use automated tools to access or extract data without prior written consent.
- Transmit harmful, offensive, or unlawful content through the Service.
- Impersonate any person or entity or falsely represent your affiliation.

Your content
Ownership. You retain ownership of any content you create or submit through the Service, such as visit notes, place names, tags, and check-in data.
License to us. By submitting content to the Service, you grant VibeXApps a non-exclusive, worldwide, royalty-free license to store, process, and use that content solely for the purpose of operating and improving the Service.
Your responsibility. You are solely responsible for the accuracy and legality of any content you submit. We reserve the right to remove content that violates these Terms.

Intellectual property
All content, features, and functionality in Presensense — including the app design, logos, text, graphics, and software — are owned by VibeXApps or its licensors and are protected by applicable intellectual property laws.
These Terms do not grant you any rights to use VibeXApps's trademarks, logos, or branding. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

Third-party services
Presensense uses third-party services to operate, including Google Firebase for database and hosting. Your use of the Service may also be subject to the terms and privacy policies of these third-party providers.
The Service may contain links to third-party websites. We are not responsible for the content, terms, or privacy practices of any third-party services.

Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, VibeXApps disclaims all warranties, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the Service will be uninterrupted, error-free, or free of harmful components.
- Any warranty regarding the accuracy or reliability of information provided through the Service.
Your use of the Service is at your sole risk.

Limitation of liability
To the fullest extent permitted by law, VibeXApps and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:
- Loss of data, revenue, profits, goodwill, or business opportunities.
- Damages resulting from your inability to use the Service.
- Damages resulting from unauthorized access to or alteration of your data.
Some jurisdictions do not allow certain liability limitations, so parts of the above may not apply to you.

Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms.
You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes that cannot be resolved informally will be resolved through binding arbitration under the rules of the American Arbitration Association, on an individual basis and not as part of any class action.

Changes to these terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice through the app or by email.
Your continued use of Presensense after changes take effect constitutes your acceptance of the updated Terms.
